No two disputes are the same; no template or predetermined formula can be deployed to assess or value all damage claims. Thresholds, burdens of proof, industry norms and established case law can guide us on how a tribunal may view similar circumstances.
A robust submission will identify the facts, establish entitlement, provide a link between events and their effects upon the planned works, and forensically allocate costs or damages. Where possible, an evidence-based approach, using contemporaneous and uncontested data, is preferred.
Disputes can escalate where the parties are unable to provide a ‘textbook’ approach to substantiating their claim. In those circumstances, my approach is to forensically interrogate the available information and set out the information required to meet the minimum threshold of proof for the applicable tribunal.
